Terms of Use

1. Acceptance

These Terms of Use (the "Terms") are an agreement between you and AI Canadian Solutions ("we", "us", "our"), the operator of RateHarp, and govern your use of the rateharp.com website and the RateHarp mobile app (together, the "Service"). By using any part of the Service you accept these Terms. If you do not accept them, do not use the Service. Our Privacy Policy forms part of these Terms.

2. Information only — not advice

RateHarp is an information service. The rates, calculators, estimates, articles, market briefs, podcasts and news on the Service are provided for general information only. Nothing on the Service is financial, mortgage, investment, tax, legal or real-estate advice, and nothing on it is an offer of credit, a rate quote, a pre-approval, an appraisal or a recommendation to enter any transaction. Always consult a licensed professional before making a financial decision.

3. No guarantee of rate accuracy

Rates shown are indicative Canadian benchmarks modelled from public data (such as the Bank of Canada) and public news sources. They are directional, not lender-specific, and they change constantly. We make reasonable efforts to keep figures current but we do not warrant that any rate, estimate or calculation on the Service is accurate, complete or up to date. Before relying on any figure, verify it directly with a lender or licensed mortgage professional. Calculator outputs (savings, home value, reverse-mortgage and similar estimates) are illustrations only and exclude fees, penalties and qualification requirements such as the mortgage stress test.

4. Directory professionals are independent third parties

The Service includes a directory of mortgage, real-estate and legal professionals and can forward your quote request to them. These professionals are independent third parties — they are not our employees, agents or partners, a listing or referral is not an endorsement, and we do not supervise or guarantee their work. Any engagement, advice, quote or transaction between you and a professional is solely between you and them, on their terms. We are not liable for the acts, omissions, advice or services of any listed professional. You are responsible for verifying a professional's licensing and suitability (for example with FSRA in Ontario or your provincial regulator).

5. AI-assisted content

Articles, market briefs and podcast episodes on the Service are produced with the assistance of artificial intelligence and reviewed editorially. AI-generated content can contain errors; it is provided "as is" as part of the informational Service and subject to sections 2 and 3.

6. Acceptable use

You agree that you will not:

  • Use the Service for any unlawful purpose;
  • Submit false, misleading or third-party information through quote, lead or claim forms, or claim a directory listing that is not yours;
  • Scrape, harvest, crawl or systematically extract data, listings or content from the Service;
  • Republish or resell Service content without our written permission;
  • Interfere with the security or availability of the Service, bypass rate limits, or probe our infrastructure for vulnerabilities;
  • Use the Service to send spam or unsolicited communications.

7. Intellectual property

The Service — including its design, code, the RateHarp name and logo, and our original articles and audio — is owned by AI Canadian Solutions and its licensors. Headlines link to their original publishers, who own their content. We grant you a personal, non-exclusive, revocable licence to use the Service for your own non-commercial information purposes.

8. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.

9. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service or these Terms is limited to one hundred Canadian dollars (CAD $100) (the Service is free to visitors). We are not liable for indirect, incidental, consequential, special, exemplary or punitive damages — including lost profits, lost savings, financial decisions made in reliance on information from the Service, or losses arising from your dealings with a directory professional — even if advised of the possibility. Some jurisdictions do not allow certain exclusions; in those jurisdictions our liability is limited to the minimum extent permitted. Nothing in these Terms limits consumer rights that cannot be waived under applicable law, including the Consumer Protection Act (Quebec).

10. Indemnification

You will defend, indemnify and hold harmless AI Canadian Solutions and its officers, employees and contractors from any third-party claim, loss or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) information you submit through the Service.

11. Termination

We may suspend or block your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, if required by law, or if your use poses a security risk. Sections 2, 3, 4, 8, 9 and 10 survive termination. You may stop using the Service at any time, and may have data you submitted erased via the Data Deletion page.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts of Ontario for any dispute arising out of these Terms, except that either party may seek injunctive relief in any competent court, and except where the law of your province of residence grants you a non-waivable right to proceed in your own province.

13. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page will change, and your continued use of the Service after a new version takes effect constitutes acceptance.
